Welcome to Vital Bloom Concierge Medical Care (“Vital Bloom,” “we,” “our,” or “us”). These Terms of Use govern your access to and use of vitalbloomconcierge.com and any related pages, booking tools, forms, or communications (together, the “Site”).
By using the Site, you agree to these Terms. If you do not agree, please discontinue use of the Site.
1. Who We Are
Vital Bloom Concierge Medical Care is a nurse practitioner-led concierge and mobile wellness practice serving Sugar Land, Stafford, Missouri City, Fresno, Riverstone, Richmond, Katy, Pearland, Rosenberg, Cypress, Houston, and surrounding communities in the Greater Houston area.
Clinical services are provided by licensed advanced practice registered nurses operating within their authorized scope of practice under applicable Texas laws and regulations.
2. Permitted Use of the Site
You may use the Site for lawful, personal, non-commercial purposes only. You agree not to:

Use the Site in any way that violates federal, state, or local law

Attempt to gain unauthorized access to any portion of the Site or our systems

Upload malicious code, scrape content, or interfere with Site functionality

Submit false, misleading, or fraudulent information through any form

Impersonate another person or misrepresent your relationship to a patient
We may modify, suspend, or discontinue any part of the Site at any time without notice.
3. Educational Information Only — Not Medical Advice
All content on the Site — including blog posts, service descriptions, wellness guides, downloadable resources, and social media links — is provided for general educational purposes only.
Site content is not medical advice and is not a substitute for individualized evaluation, diagnosis, or treatment.
Viewing the Site, submitting a form, or sending a message does not create a provider-patient relationship. That relationship begins only when you have completed intake, been formally accepted as a patient, and had a clinical encounter with a Vital Bloom provider.
Individual results vary. No outcome is promised or guaranteed, including with respect to weight management, hormone support, or any wellness therapy.
Always consult your own qualified healthcare provider before starting, stopping, or changing any treatment, medication, supplement, or exercise program.
4. Medical Emergencies
The Site and our messaging channels are not monitored 24/7 and must never be used for emergencies.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately. If you are experiencing a mental health crisis, call or text 988 (Suicide & Crisis Lifeline).
Do not use email, text message, web forms, or social media to report urgent symptoms.
5. Appointments, Scheduling, and Payment
Booking requests submitted through the Site are requests only and are not confirmed until Vital Bloom confirms them directly.
Services, packages, and pricing displayed on the Site may change and are subject to clinical eligibility. Not every patient is a candidate for every service.
Deposits, cancellation windows, no-show fees, membership terms, and refund policies are set out in the service agreement or membership terms you receive at the time of booking. Those documents control if they conflict with general Site content.
Vital Bloom is a cash-pay / direct-pay practice unless expressly stated otherwise. You are entitled to a Good Faith Estimate of expected charges as described in our Good Faith Estimate notice.
6. Telehealth
Where offered, telehealth visits are provided only to patients physically located in a state where the treating provider holds an active license at the time of the visit.
Telehealth has limitations, including the inability to perform a hands-on physical examination. Separate informed consent is required before any telehealth encounter and is addressed in our Telehealth Consent document.
7. Text Message (SMS) Communications
By providing your mobile number to Vital Bloom — through a Site form, booking tool, or in writing — you consent to receive text messages from us at that number, including messages sent using automated technology.
Message types may include appointment scheduling and reminders, care follow-up, refill and lab notifications, billing notices, and, where you have separately opted in, promotional or educational messages.
Consent is not a condition of purchase or of receiving care.
Message and data rates may apply. Message frequency varies.
To opt out, reply STOP to any message. Reply HELP for assistance, or contact us at 832-466-3180 or care@vitalbloomconcierge.com.
Opting out of marketing messages will not stop essential care- or billing-related communications sent as part of your treatment.
Standard SMS is not a secure or encrypted channel. Do not send sensitive clinical details, images, or payment information by text. By opting in, you acknowledge and accept this risk.
8. Email and Electronic Communication
Unencrypted email carries similar risks.
Please limit email to scheduling and general administrative matters, and use our secure patient portal or a scheduled visit for anything clinical.
9. Intellectual Property
All content on the Site — including text, graphics, logos, photographs, patient education materials, program frameworks, forms, guides, and downloadable documents — is owned by or licensed to Vital Bloom Concierge Medical Care and is protected by U.S. copyright and trademark law.
“Vital Bloom Concierge Medical Care,” “Bloom Body,” the lotus mark, and “Wellness that blooms from within” are trademarks or service marks of Vital Bloom Concierge Medical Care.
You may view, download, and print Site materials for your own personal, non-commercial use. Any reproduction, redistribution, resale, republication, or use in another practice’s materials is prohibited without our prior written permission.
10. Third-Party Links, Platforms, and Vendors
The Site may link to or integrate third-party platforms for scheduling, payment, patient financing, lab ordering, or communication.
These platforms are governed by their own terms and privacy policies. Vital Bloom does not control and is not responsible for the content, security practices, or availability of any third-party site or service.
11. User Submissions and Feedback
Any suggestion, idea, testimonial, review, photograph, or other material you voluntarily submit to us (other than protected health information, which is governed by our Privacy Practices) is considered non-confidential.
You grant Vital Bloom a perpetual, royalty-free license to use it, and you confirm you have the right to provide it.
We will never publish a patient photograph, testimonial, or identifiable story without your separate signed written authorization.
12. No Warranties
The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
This section limits warranties regarding the Site. It does not limit or waive the standard of care applicable to clinical services actually rendered to you as a patient.
13. Limitation of Liability
To the fullest extent permitted by Texas law, Vital Bloom Concierge Medical Care and its owners, providers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of the Site, or your reliance on Site content.
Nothing in these Terms limits any liability that cannot lawfully be limited, including liability related to the actual provision of professional medical services.
14. Indemnification
You agree to indemnify and hold harmless Vital Bloom Concierge Medical Care, its owners, employees, and contractors from any claim, loss, or expense (including reasonable attorney’s fees) arising from your misuse of the Site, your violation of these Terms, or your infringement of another party’s rights.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute arising from the Site or these Terms shall be brought exclusively in the state or federal courts located in Fort Bend County, Texas, and you consent to that jurisdiction.
16. Changes to These Terms
We may update these Terms at any time.
The revised version will be posted here with a new Effective Date, and your continued use of the Site constitutes acceptance.
